These Terms of Service (“Terms”) govern your access to and use of Veriform’s lead verification and consent capture services (“Services”). By using our Services, you agree to these Terms.


1. Acceptance of Terms #

By creating an account or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use our Services.


2. Description of Services #

Veriform provides:

  • Session Recording: Capture user interactions on forms and websites
  • Consent Certificates: Generate tamper-proof documentation of user consent
  • Lead Verification: Validate lead authenticity with IP, geolocation, and behavioral data
  • API Access: Integrate verification into your workflows

3. Account Registration #

To use our Services, you must:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials and API keys
  • Notify us immediately of any unauthorized access
  • Be at least 18 years old

You are responsible for all activity under your account.


4. Acceptable Use #

You agree NOT to:

  • Use the Services for any unlawful purpose
  • Record sessions without proper user disclosure and consent
  • Collect sensitive data (passwords, SSN, credit card numbers) without appropriate safeguards
  • Attempt to reverse engineer, hack, or disrupt the Services
  • Resell or redistribute the Services without authorization
  • Violate any applicable laws, including TCPA, CCPA, and GDPR

5. Fees and Payment #

  • Subscription Plans: Pricing is as described on our Billing page
  • Billing Cycle: Subscriptions are billed monthly
  • Metered Usage: Claims beyond included quantities are billed at your plan’s overage rate
  • Payment Method: We use Stripe for payment processing
  • Taxes: You are responsible for applicable taxes

6. Data Ownership #

  • License to Veriform: You grant us a license to process your data to provide the Services
  • Aggregate Data: We may use anonymized, aggregate data for analytics and service improvement

7. Data Retention #

  • Consent certificates and session recordings are retained according to your subscription plan
  • Retention requires an active subscription
  • Upon subscription cancellation, data may be deleted before the retention period expires
  • You may request data export before cancellation

8. Intellectual Property #

  • Veriform IP: The Services, including software, APIs, and documentation, are owned by Veriform
  • Trademarks: “Veriform” and our logo are trademarks of Veriform
  • Feedback: Any feedback you provide may be used by us without obligation

9. Disclaimer of Warranties #

THE SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that:

  • The Services will be uninterrupted or error-free
  • Consent certificates will be accepted by all courts or regulators
  • The Services will meet all legal requirements in your jurisdiction

10. Limitation of Liability #

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VERIFORM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.


11. Indemnification #

You agree to indemnify and hold harmless Veriform from any claims, damages, or expenses arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your failure to obtain proper consent from end users

12. Termination #

  • By You: You may cancel your subscription at any time
  • By Us: We may suspend or terminate your account for violation of these Terms
  • Effect: Upon termination, your access to the Services will end, and data may be deleted before the retention period

13. Changes to Terms #

We may modify these Terms at any time. Material changes will be communicated via email or notice on our website. Continued use after changes constitutes acceptance.


14. Governing Law #

These Terms are governed by the laws of the State of FL, USA, without regard to conflict of law principles.


15. Dispute Resolution #

Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive the right to participate in class actions.


16. Miscellaneous #

  • Entire Agreement: These Terms constitute the entire agreement between you and Veriform
  • Severability: If any provision is found unenforceable, the rest remain in effect
  • Waiver: Failure to enforce a right does not waive it
  • Assignment: You may not assign these Terms; we may assign them freely
